Terms and Conditions

Effective from 07.10.2026. These terms apply to the online shops starmoto.ee, starmoto.eu, starmoto.fi, starmoto.lv, starmoto.lt, starmoto.se, lastemoto24.ee, atvkeskus.ee, jalgrattapood.ee, laagersimmer.ee, rehvidkummid.ee and starmarine.ee.

2. General

  1. These terms apply to sales contracts concluded in the online shop. For consumers, the Estonian Law of Obligations Act and Consumer Protection Act also apply; these terms do not limit the consumer's statutory rights.
  2. The terms applicable to an order are those in force at the time the order was placed. We announce changes in the online shop and they do not affect orders already placed.
  3. The buyer confirms that they are at least 18 years old or are acting with the consent of their legal representative.

3. Products, prices and availability

  1. Prices are in euros and include VAT. The delivery charge is calculated in the shopping basket before payment according to the country and delivery method.
  2. The delivery time shown next to a product is the time within which we dispatch the goods. When the goods arrive depends on the delivery method chosen; see Delivery and delivery times.
  3. A large proportion of our goods are held in our partners' warehouses, and stock levels are updated several times a day. If a product has sold out in the meantime, we will contact you and offer a new delivery time, an equivalent substitute product or a refund. Refunds are made within 14 days.
  4. Product images are for illustration only. If there is an obvious error in a product description or price, we will notify you and the buyer has the right to cancel the order.
  5. Products marked “Ask for availability” cannot be purchased immediately in the online shop: please ask about availability by telephone or e-mail.

4. Ordering and conclusion of the contract

  1. The contract is concluded when the buyer has placed the order and paid for it (or concluded an instalment agreement). We send an order confirmation by e-mail.
  2. The buyer is responsible for the accuracy of the details provided. Any additional costs arising from an incorrect address (e.g. re-delivery) are borne by the buyer.

5. Delivery and handover of goods

  1. Delivery methods and prices are set out on the Delivery and delivery times page. Where products have different delivery times, we dispatch the goods together once the product with the longest delivery time is available, unless agreed otherwise.
  2. The risk of accidental loss of the goods passes to the consumer when they or a person designated by them have received the goods.
  3. Please check the parcel on receipt. Report any damage caused in transit to the courier and to us at the earliest opportunity, preferably with photos.

6. Right of withdrawal (14 days)

  1. The consumer has the right to withdraw from the contract within 14 days of receiving the goods without giving any reason. For an order delivered in several parts, the period begins on receipt of the last part.
  2. To withdraw, send a clear statement using the returns form or by e-mail to [email protected], stating the order number. You may use the model form below, but it is not obligatory.
  3. You must return the goods no later than 14 days after sending the withdrawal notice to Starmoto OÜ, Akadeemia tee 78, 13520 Tallinn, Estonia, or bring them to our shop.
  4. The consumer bears the direct cost of returning the goods, unless we sent the wrong goods or defective goods. For powersport vehicles and other bulky goods that cannot be returned by post (e.g. an ATV, motorcycle or boat), the return transport cost is estimated at up to €150 within Estonia and up to €400 to other countries.
  5. We will refund all payments received from the consumer, including the original standard delivery charge, no later than 14 days after receiving the withdrawal notice. We may withhold the refund until we have received the goods back or the consumer has supplied evidence of having sent them back. The money is refunded to the same account or by the same payment method used for payment.
  6. The goods may be examined in the same way as would be possible in a shop. The consumer is liable for any diminished value of the goods resulting from handling them in any other way. For a part that has been fitted to or used on a vehicle (including riding gear that has been worn), we will deduct from the refund the diminished value, which may amount to the full price of the goods.
  7. The goods may be taken out of their packaging for examination. If the original packaging has been damaged so that the goods cannot be sold as new (e.g. a broken helmet box), we will deduct from the refund the cost of new packaging or the resulting diminished value.
  8. The right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised to their needs, to sealed goods which are not suitable for return due to health protection or hygiene reasons if they have been unsealed after delivery, or to goods which, after delivery, have been inseparably mixed with other items (e.g. oil or fluid poured into an engine).
  9. The right of withdrawal applies to consumers. Returns from business buyers are handled by agreement.

7. Non-conforming goods and complaints

  1. The consumer has the right to make a claim regarding the lack of conformity of the goods with the contract within two years of receiving them. If a defect becomes apparent within the first year, it is presumed to have existed at the time of delivery.
  2. Notify us of the defect within two months of discovering it by e-mail to [email protected], including the order number, a description and, if possible, photos. We will respond within 15 days.
  3. We will repair or replace defective goods, or refund the money, in accordance with the law. The manufacturer's warranty, where one is given for the product, applies in addition to your statutory rights.
  4. A claim does not cover defects caused by normal wear and tear, incorrect fitting, improper use, use in competition or failure to carry out the maintenance prescribed by the manufacturer (e.g. mandatory service intervals for vehicles).

8. Liability

We are liable for breach of contract to the extent provided by law. We are not liable for indirect damage, except in the case of intent or gross negligence. This does not limit the consumer's rights.

9. Personal data

The processing of personal data is described in our privacy policy.

10. Disputes

  1. We try to resolve complaints through negotiation. Write to [email protected].
  2. If no agreement is reached, the consumer may turn to the Consumer Disputes Committee (Consumer Protection and Technical Regulatory Authority, Endla 10a, 10122 Tallinn, Estonia, www.ttja.ee) or to a court. A consumer from another EU country may also contact the European Consumer Centre in their own country (European Consumer Centres Network, ECC-Net).
  3. The contract is governed by Estonian law. The mandatory consumer protection provisions of the law of the consumer's country of residence continue to apply.
